CC Swim Schools – Terms and Conditions
Venue: Lusty Beg Island Resort
These Terms and Conditions apply to all swimming lessons delivered by CC Swim Schools ("the Swim School", "we", "us") at the pool facility accessed via Lusty Beg Island Resort, near Boa Island / Kesh, County Fermanagh ("the Venue"). By booking, attending, or allowing a participant to attend a lesson, you ("the Client", "you") agree to be bound by these Terms.
Nothing in these Terms affects your statutory rights under Northern Ireland law.
1. Definitions
1.1 "Participant" means the person attending the swimming lesson.
1.2 "Client" means the parent, guardian, or person responsible for booking and/or accompanying the Participant.
1.3 "Instruction Period" means the scheduled lesson time during which the Participant is under the active supervision of the Swim School instructor in the pool.
1.4 "Venue" means Lusty Beg Island Resort and all associated access routes, ferry services, docks, walkways, ramps, buildings and surrounding grounds.
2. Nature of Service and Scope
2.1 The Swim School provides swimming instruction only.
2.2 The Swim School does not own, manage, control, inspect, or maintain the Venue, ferry service, docks, walkways, slopes, ramps, lighting, cleaning systems, or site-wide risk assessments.
2.3 Responsibility for the maintenance and safety management of the Venue rests with the Venue operator.
3. Access, Environment and Personal Responsibility
3.1 Access to the pool requires navigation of a natural lakeside environment.
3.2 Weather conditions in Northern Ireland are variable and may affect underfoot safety.
3.3 Slopes, ramps, gangways, ferry decks, docks and walkways may become significantly more hazardous when wet.
3.4 The primary responsibility for personal safety during transit to and from the pool rests with the Client.
3.5 Clients must exercise heightened caution during adverse weather, use handrails where provided, wear suitable footwear, and ensure minors in their care do the same.
4. Ferry Transit
4.1 The ferry service is operated by a third party and is outside the control of the Swim School.
4.2 Ferry decks and boarding ramps may be slippery when wet.
4.3 Ferry services may be suspended due to weather, mechanical failure, or operational reasons.
4.4 The Swim School is not liable for delays arising from ferry non-operation.
4.5 If a lesson is cancelled by the Swim School due to ferry suspension, a rescheduled session or refund for that lesson will be offered. No additional travel or consequential costs will be covered.
5. Supervision and Conduct
5.1 All children under 16 must be accompanied by a responsible adult outside the Instruction Period.
5.2 A strict one adult per child supervision ratio applies before and after lessons.
5.3 A strict No-Running policy applies across the entire site, including car parks, docks, ferry decks, access routes and pool surrounds.
5.4 Failure to comply with safety instructions may result in removal from the session without refund.
6. Duty of Care
6.1 The Swim School’s duty of care applies only during the Instruction Period.
6.2 Parents and guardians remain responsible for supervision before and after lessons and during all transit and waiting periods.
7. Venue Terms
7.1 The Venue operates under its own Terms, safety notices and operational policies.
7.2 By attending, Clients agree to comply with the Venue’s independent Terms in addition to these Terms.
7.3 Responsibility for maintenance and inspection of slopes, ramps, docks, ferry systems and access routes rests with the Venue operator.
8. Health and Medical Disclosure
8.1 Clients must disclose any relevant medical conditions prior to participation.
8.2 Participation must not occur where illness poses a risk to the Participant or others.
9. Safeguarding
9.1 No mobile phones or recording devices may be used in pool or changing areas.
9.2 CCTV may operate for safety and insurance purposes.
9.3- Children over the age of 8 years old should be in the correct designated changing room. If an adult is present please make sure they are also in the correct changing area.
10. Cancellations
10.1 If the Swim School cancels a lesson due to safety, illness or Venue unavailability, a reschedule or refund for that lesson will be offered.
10.2 Client cancellations are non-refundable and Non Transferable. Rescheduling may be offered at the discretion of the Swim School where reasonable notice is provided.
11. Limitation of Liability
11.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or any liability that cannot lawfully be excluded under Northern Ireland law.
11.2 Subject to clause 11.1, liability is limited to proven negligence during the Instruction Period.
12. Governing Law
These Terms are governed by the laws of Northern Ireland and subject to the exclusive jurisdiction of its courts.
13. Client Agreement and Confirmation
By signing below or by completing an online booking and ticking the agreement box, the Client confirms that:
- They gave read and understood these Terms and Conditions in Full.
- They accept that CC Swim Schools provides swimming instruction only and does not control the Venue or Ferry operations.
- They accept responsibility for safe conduct during transit and outside the Instruction Period.
- They agree to comply with the Venue’s independent Terms and safety rules.
